Government Court vs Traditional Court
Every community has conflict. The question is where do we take it. Many people are confused. Some go to the chief for murder. Some go to police for family land. This causes delay, anger, and broken relationships. This short course teaches community leaders the difference between Government Court and Traditional Court. You will learn when to use each system, how to avoid corruption and forum shopping, and how to strengthen Traditional Courts so they serve people with fairness and dignity. This course is not about choosing one side. It is about using wisdom so both systems bring peace. Through research, case studies, and community dialogue, you will build thinking capacity and take real action in your community.
By the end of this course, you will be able to:
1. Explain clearly what a Traditional Court is and what a Government Court is
2. List the key differences between the two systems in speed, cost, language, evidence, and enforcement
3. Decide correctly which types of cases belong to Traditional Court and which belong to Government Court
4. Identify the dangers of forum shopping, corruption, and disrespect between systems
5. Design practical steps to strengthen your community Traditional Court in capacity, accountability, and documentation
6. Build partnership between elders, police, and magistrates for community peace
7. Lead 1 community dialogue that agrees on 3 rules for using both courts wisely
8. Commit to uphold justice, fairness, and dignity as a leader

Module 1: Understanding Both Systems
1. What is a Traditional/Community Court? Role of elders, chiefs, headmen 2. What is a Government/Magistrate Court? Role of police, magistrates, law books 3. Key differences: Speed, Cost, Language, Evidence, Enforcement 4. When God uses both: Romans 13 + Proverbs elders
Activity:
Research in your community. List 5 cases handled by traditional court and 5 by government court last year.
Module 2: When to Use Which Court
1. Cases for Traditional Court: Land disputes in family, marriage issues, debt between neighbors, minor assaults, inheritance talks 2. Cases for Government Court: Murder, rape, fraud, armed robbery, constitutional matters 3. The danger of forum shopping and corruption 4. How to refer a case properly without disrespecting either side

Module 3: Strengthening Traditional Courts
1. Capacity: Train elders in record keeping, mediation skills, and basic human rights 2. Accountability: Minutes, witnesses, no bribes, transparent decisions 3. Partnership: How traditional leaders can work WITH police and magistrates, not against 4. Documentation: Write down judgments so they are respected by government 5. Youth involvement: Raise young people to respect and serve in traditional structures

Module 4: Building Peace in Your Community
1. Preventing cases before they start: Dialogue, family meetings 2. Restorative justice vs punishment only 3. Your role as a leader: Be a bridge, not a divider 4. Covenant: Commit to uphold justice, fairness, and dignity Graduation Project: Host 1 community dialogue with elders + 1 police officer to agree on 3 rules for how your community will use both courts.
